We examine the impact of an ethics education program on reporting behavior using two groups of students: fourth year Masters of Accounting students who just completed a newly instituted ethics education program, and fifth year students in the same program who did not receive the ethics program. In an experiment providing both the opportunity and motivation to misreport for more money, we design two social condition treatments – anonymity and public disclosure – to examine whether or to what extent ethical (...) values are internalized by students. We find that when participants are anonymous, misreporting rates are nearly the same regardless of ethics program participation. However, when their reporting behavior is made public to the cohort, participants who completed the ethics program misreported at significantly lower rates than those who did not receive the ethics program. The results suggest that ethics education does not necessarily result in internalized ethical values, but it can impact ethical behavior. (shrink)

Introspection, or metacognition, is the capacity to reflect on our own thoughts and behaviours. Here, we investigated how one specific metacognitive ability develops in adolescence, a period of life associated with the emergence of self-concept and enhanced self-awareness. We employed a task that dissociates objective performance on a visual task from metacognitive ability in a group of 56 participants aged between 11 and 41 years. Metacognitive ability improved significantly with age during adolescence, was highest in late adolescence and plateaued going (...) into adulthood. Our results suggest that awareness of one’s own perceptual decisions shows a prolonged developmental trajectory during adolescence. (shrink)

We surveyed 1005 postdoctoral fellows by questionnaire about ethical matters related to biomedical research and publishing; 33% responded. About 18% of respondents said they had taken a course in research ethics, and about 31% said they had had a course that devoted some time to research ethics. A substantial majority stated willingness to grant other investigators, except competitors, access to their data before publication and to share research materials. Respondents’ opinions about contributions justifying authorship of research papers were mainly consistent (...) but at variance with those of many biomedical journal editors. More than half said they had observed what they considered unethical research practices. To increase the chances of getting a grant funded, 27% said they were willing to select or omit data to improve their results; to make publication of their work more likely or to benefit their career, 15% would select or omit data and 32% would list an undeserving author. Of respondents who thought they had been unfairly denied authorship on a paper, or been listed with or asked to list an undeserving author, 75% said they would be willing to list an undeserving author (P<0.001). Having taken a course dealing with research ethics had no effect on stated willingness to select or omit data or to fabricate data in the future, but was positively associated with willingness to grant undeserved authorship (P<0.04). Although these results do not controvert research demonstrating the effectiveness of ethics courses during professional education, they indicate that the research environment is a powerful component of a trainee’s experience and ethical development. The problem of collective action is that each member of a group wants other members to make necessary sacrifices while he or she 'free rides', reaping the benefits of collective action without doing the work. Inevitably the end result is that no one does the work and the common interest is not realized. This book analyses the social pressure whereby groups solve the problem of collective action. The authors show that the problem of collective action requires a model of group (...) process and cannot be deduced from simple models of individual behaviour. They employ formal mathematical models to emphasize the role of small subgroups of especially motivated individuals who form the 'critical mass' that sets collective action in motion. The book will be read with special interest by sociologists, social psychologists, economists and political scientists. Ideas of love within religion are usually driven by one of two mythologies – either a personal God who commands love or a mystical God of ineffable love – but both are inadequate for motivating love of neighbour. The first tends towards legalism and the second offers no cognitive guidance. The situation is further complicated by there being different understandings of love of neighbour in the various Abrahamic religions, as exemplified in the approaches of two philosophers, Søren Kierkegaard and Emmanuel (...) Levinas. A better approach is therefore to explore actual practices of love in everyday life, and to discover how love might be performed openly and creatively. One such practice is recognition of vulnerability, and this too is often driven by a mythology, in this case one marked by fear, and by a violence either imposed or avoided. One paradigmatic example is the vulnerability felt by speakers, especially women, in front of an audience. A turning from wilful ignorance of vulnerability and a turning to reliance on collective work, modelled on an awareness of mutual vulnerability and openness to the unknown, will help to change our philosophical and social imaginary. The dark myth of vulnerability can be transformed into finding opportunities in vulnerability for openness to affection and so to an enhancement of life. It is only from the perspective of this new imaginary, and from everyday practices of it, that the double love-command – love of God and love of neighbour – will function as any kind of common ground between religions. In this paper, we claim that we can only seek to eradicate the stigma associated with the contemporary opioid overdose epidemic when we understand how opioid stigma and the epidemic have co-evolved. Rather than conceptualizing stigma as a parallel social process alongside the epidemiologically and physiologically defined harms of the epidemic, we argue that the stigmatized history of opioids and their use defines the epidemic. We conclude by offering recommendations for disrupting the burden of opioid stigma.

Advocacy is an important concept in nursing practice; it is frequently used to describe th nurse-client relationship. The term advocacy, however, is subject to ambiguity of interpretation. Such ambiguity was evidenced recently in criticisms levelled at the nursing profession by hospital ethicist Ellen Bernal. She reproached nursing for using 'patient rights advocate' as a viable role for nurses. We maintain that, for nursing, patient advocacy may encompass, but is not limited to, patient rights advocacy. Patient advocacy is not merely the (...) defence of infringements of patient rights. Advocacy for nursing stems from a philosophy of nursing in which nursing practice is the support of an individual to promote his or her own well-being, as understood by that individual. It is an ethic of practice. La défense des malades joue un grand rôle dans la pratique des infirmiers/ères. Le terme est souvent utilisé pour définir les rapports entre malades et soignants. Le mot 'defénse' pourtant, peut être mal compris. Une ambiguïté était évidente récemment dans la critique de la profession infirmière faite par la philosophe éthique Ellen Bernal. Elle reproche à la profession d'utiliser le terme 'avocat des droits des malades' pour désigner le rôle primordial des infirmiers/ères. Nous croyons que pour les soignants, la défense des malades peut comprendre le rôle 'd'avocat des droits des malades' mais elle ne s'y borne pas. La défense n'est pas limitée à la défense des infractions des droits des malades. La défense dans la profession infirmière est basée sur une philosophie où la pratique infirmière est le soutien des malades dans leur quête de promouvoir leur propre bien-être. Die Fürsprache spielt eine wichtige Rolle in der Krankenpflege. Sie wird oft als kennzeichnend für die Beziehung zwischen Patient und Pflegepersonal beschrieben. Der Ausdruck 'Fürsprache' kann aber auch mehrdeutig interpretiert werden. Das wurde letzthin in der Kritik der Ethikerin Ellen Bernal an der Krankenpflege sichtbar. Sie machte den Pflegenden den Vorwurf, dass sie sich die Rolle des 'Rechts-Advokat des Patienten' aneignen. Wir sind der Meinung, dass es die Aufgabe des Pflegepersonals ist, auch die Rechte der Patienten zu vertreten, aber dass das nur ein Teil der Fürsprache ist. Sie ist nicht nur Verteidignung von verletzten Patientenrechten. Die Fürsprache in der Krankenpflege stammt von einer Philosophie, deren Ausübung die Unterstützung der Patienten für ihr Wohlergehen zum Ziel hat, so wie die Patienten selbst ihr Wohlergehen verstehen. This paper aims to call attention to the potential of using film in engineering ethics education, which has not been thoroughly discussed as a pedagogical method in this field. A review of current approaches to teaching engineering ethics reveals that there are both learning outcomes that need more attention as well as additional pedagogical methods that could be adopted. Scholarship on teaching with film indicates that film can produce ethical experiences that go beyond those produced by both conventional methods of (...) teaching engineering ethics and more arts-based methods such as fiction, as well as connect ethics learning outcomes and issues to the lifeworld of a person. The paper further illustrates the potential of using Miyazaki Hayao’s film The Wind Rises for highlighting a range of ethical issues pertaining to engineering. It also discusses the important role educators play in how film can be used effectively in the classroom. Synthesizing a range of sources from film theory to the use of film in business and medical education, the paper makes the case for using film in engineering ethics education and calls for more research on the use of this method. Concepts and Cases in Nursing Ethics is a case-based exploration of the core principles of health care ethics applied to nursing. The book is a collaboration between philosopher-ethicist Michael Yeo and nurse-ethicist and educators Anne Moorhouse, Pamela Khan, and Patricia Rodney. It thus combines philosophical and ethical analysis with extensive knowledge and experience in nursing and health care. The book is organized around six main concepts in health care ethics: beneficence, autonomy, truthfulness, confidentiality, justice, and integrity. A chapter is (...) devoted to the elucidation of each of these concepts. In each chapter, historical background and conceptual analysis are supplemented by case studies that exemplify issues and show how the concept applies in health care and nursing practice. In this new edition, the conceptual analysis throughout has been updated and reworked in view of changes in the health care system. In addition, there is a new chapter specifically devoted to recent developments affecting nursing and other health professions. Previous case studies have been modified and new ones added to address current and emerging issues. Although the text focuses mainly on the social and political situation of nursing, the analysis has relevance also for medicine and the allied health professions, and indeed for anyone working in the health system. We suggest that mammalian endothermy was established amongst Middle Jurassic crown mammals, through reviewing state‐of‐the‐art fossil and living mammal studies. This is considerably later than the prevailing paradigm, and has important ramifications for the causes, pattern, and pace of physiological evolution amongst synapsids. Most hypotheses argue that selection for either enhanced aerobic activity, or thermoregulation was the primary driver for synapsid physiological evolution, based on a range of fossil characters that have been linked to endothermy. We argue that, rather than (...) either alternative being the primary selective force for the entirety of endothermic evolution, these characters evolved quite independently through time, and across the mammal family tree, principally as a response to shifting environmental pressures and ecological opportunities. Our interpretations can be tested using closely linked proxies for both factors, derived from study of fossils of a range of Jurassic and Cretaceous mammaliaforms and early mammals. (shrink)

The objective of this study is to evaluate if use of a patient decision aid, when choosing between a repeat cesarean or a trial of labor after a cesarean, reduces medical liability exposure. The authors conclude that use of a PDA conferred liability protection when potential jurors were presented with a hypothetical malpractice claim against an obstetrician following a TOLAC.

Kevin McCain’s Evidentialism and Epistemic Justification is the most thorough defense of evidentialism to date. In this work, McCain proposes insightful new theses to fill in underdeveloped parts of evidentialism. One of these new theses is an explanationist account of evidential fit that appeals to dispositional properties. We argue that this explanationist account faces counterexamples, and that, more generally, explanationists should not understand evidential fit in terms of dispositional properties.

Este artículo reflexiona acerca de las especificidades de la constitución de los monumentos conmemorativos en vínculo con la historia reciente. Para ello, la mirada se centrará en la noción de contramonumentos, entendiendo a estos últimos como aquellas producciones que, inicialmente de la mano de un grupo de artistas alemanes, desafían las premisas del monumento tradicional. En base a esto, se expone, en primera instancia el desarrollo histórico del monumento, destacando determinados sucesos que se consideran significativos dentro de la extensa cronología (...) en la que éste se inscribe; en un segundo momento, se recuperan una serie de reflexiones y debates que problematizan y cuestionan la efectividad de estos objetos culturales en relación a la evocación del pasado; y finalmente, se presentan y analizan un conjunto de producciones artísticas que se enmarcan dentro de lo que se reconoce como contramonumentos. En este sentido, se considera que la revisión de los aspectos formales, conceptuales y funcionales a partir de las cuales James E. Young definió en la década de los noventa a los contramonumentos, ilumina y habilita nuevas reflexiones sobre las diversas intervenciones, acciones de resistencia y producciones artísticas que se llevan a cabo en la actualidad, muchas de las cuales pueden ser pensadas como contramonumentos. In my response-paper, I dispute the claim of Firestone and Jacobs that “Kant’s turn to transcendental analysis of the moral disposition via pure cognition is perhaps the most important new element of his philosophy of religion” (In Defense of Kant’s Religion, 233). In particular, I reject the role given—in the latter—to “pure cognition.” Instead I propose a Kantian variation on cognition which remains consistent with Kant’s moral postulate for the existence of God. I urge that we treat this postulate as (...) regulative. So, in place of pure cognition, “belief in” God grounds our hope for perfect goodness. (shrink)

Physicians and other health care providers owe ethical and legal duties to patients to maintain the secrecy of the information learned during the course of patient care. This obligation is fulfilled by limiting access to such information to only those involved in the patient's care-that is, to those within the “circle of confidentiality.” As a general rule, providers may only disclose to others with the written prior consent of the patient. Exceptions may be “ethically and legally justified because of overriding (...) social considerations,” when permitted or compelled by law. For example, eleven states permit providers to disclose identified records to approved researchers.’ Many states compel disclosure in cases where a patient threatens serious bodily harm to another; require reporting to health or law enforcement authorities of communicable diseases, gunshot or knife wounds, or child abuse; and mandate reporting of cancer or other health care cases to state registries. The authors study the impact of institutional corporate social responsibility —defined as CSR targeted at a borrowing firm’s secondary stakeholders—on bank loans. Findings suggest that higher levels of institutional CSR are associated with lower levels of interest rates and loan spreads. In addition, institutional CSR also tempers the positive impact of loan maturity and firm leverage on interest rates and loan spread. These effects were strongest among firms that demonstrated sustained performance, rather than among firms that showed mixed performance in (...) terms of their secondary stakeholder-related activities. This study indicates institutional CSR is valued by stakeholders for its risk mitigating and transaction cost reducing effects independent of technical CSR, defined as CSR targeted at primary stakeholders. La justicia social tiene sus fundamentos políticos en el pensamiento de Nancy Fraser en el carácter económico de la sociedad, pero no la comprende con exclusividad, dado que existen dos dimensiones más que la complementan, el reconocimiento cultural y la representación política. En este contexto de estado de emergencia, surge la necesidad de comprender holísticamente el sentido de la justicia social y aplicarlo a la realidad peruana. De esta manera podemos evidenciar las falencias que existen dentro de cada dimensión, y (...) las medidas que el estado peruano ha tomado dentro de cada dimensión para contrarrestar o en su defecto solucionar el impacto de la pandemia. Durante la exposición de los tópicos abordaremos detalladamente que comprende la autora en cuestión acerca de los términos redistribución, reconocimiento y representación, dentro del marco de la Justicia Social y buscaremos extrapolar estas nociones teóricas a la realidad peruana dentro de la coyuntura de la pandemia, las manifestaciones de las particularidades. El presente trabajo saca a relucir no solo la improvisación de las medidas que no satisfacen las necesidades básicas que demandan cada dimensión, sino ofrece, a su vez, una crítica hacia la comprensión política de nuestras autoridades, las cuales no apuntan a alcanzar este estado de justicia social. Dicho estado de justicia tiene como horizonte un verdadero reconocimiento sostenido en cambios estructurales, para ello ineludiblemente se tiene que abordar el problema de la crisis económica, que se expresa en la desigualdad de condiciones y la falta de oportunidades. La justicia social siempre ha representado un ideal de sociedad, hasta el punto de concebirlo como un horizonte inalcanzable. Asociar la justicia con la igualdad o equidad no forma parte de la perspectiva política del país y esto se evidencia en el carácter amortiguador de los decretos legislativos establecidos por el Estado. Sin embargo, la ayuda del Estado no llega a todos los sectores de la población, y si es que llega, es asumida por el propio ciudadano mediante el retiro de su CTS o AFP. La realidad es distinta cuando se trata de las empresas, quienes tienen la potestad de despedir sin goce de haber a sus trabajadores bajo la modalidad de suspensión perfecta de labores. Dicha medida, es “perfecta” para la empresa quien no solo goza de este beneficio sino también puede acceder a un financiamiento de parte del Estado. En la sociedad la figura de la empresa se posiciona como indispensable, debido a que movilizan la economía al otorgar puestos de trabajo. Sin embargo, la integridad de los trabajadores no se ha visto como prioridad para dichas empresas, puesto que se concibe la fuerza de trabajo como un rubro que puede remplazarse con facilidad. De esta manera se evidencia una notable intención por no impartir con equidad mayores beneficios para aquellos que realmente están en una situación de desventaja. Por otro lado, los actos de corrupción acentúan la necesidad de una justicia social no como utopía sino como una obligación moral que se convierte en una exigencia patriótica. Aunque apuntemos a un reconocimiento de nuestras condiciones de existencia, dentro de nuestras particularidades, y a partir de este reconocimiento poder tener representación en las instancias a las que nos correspondan participar no existirá un verdadero reconocimiento sin una verdadera redistribución. New discoveries in neuroscience challenge our understanding of human responsibility and justice. Recent studies suggest that psychopaths not only exhibit specific behavioral patterns but may also have a distinct neuroanatomical blueprint. Scientists have shown that a significant number of individuals who have demonstrated psychopathic behaviors have reduced volume and other anatomical changes in various regions of the cerebral cortex as well as decreased functional connectivity between different brain areas (i.e., smaller dysfunctional amygdalae). These findings raise ethical questions about how our (...) criminal system deals with these individuals. Should dysfunctional anatomical or diseased features exonerate affected individuals from any responsibility for their criminal activity or the suffering they have caused to their victims? It is estimated that individuals with the signs and symptoms of antisocial personality disorder make up 25% of inmates. Should individuals classified with this disorder be incarcerated with other criminals? In this paper, we summarize the results of the latest brain imaging studies performed on individuals with antisocial personality traits, referred to as psychopaths or sociopaths, and we explore some of the ethical issues concerning psychopathy and the law. The purpose of this article is to explore the law related to identity theft, to review corresponding rights, and responsibilities of stakeholders involved in identity theft and to formulate a system of best practices businesses could engage in to prevent or reduce identity theft threats. Utilizing two ethical frameworks based on deontological approaches, the authors conclude that there should be a well-defined management scheme to prevent identity theft, which is easy to comprehend and comply with for all stakeholders. Our proposed (...) management scheme incorporates both legal and ethical elements such that identity theft will be more difficult. Further, our proposal would also address business entities’ practices that are so careless that identity theft is made possible at all or made easier: ethical business practice can do much to reduce or eliminate identity theft. Human rights theory generally conceptualizes freedom of thought, conscience, religion, and belief as well as freedom of opinion and expression, as offering absolute protection in what is called the forum internum. At a minimum, this is taken to mean the right to maintain thoughts in one’s own mind, whatever they may be and independently of how others may feel about them. However, if we adopt this stance, it seems to imply that there exists an absolute right to hold psychotic delusions. (...) This article takes the position that this conclusion is ethically problematic from the perspective of psychiatric treatment and the rights of persons with psychosis. The article reflects on this particular challenge and sets forth an understanding of freedom in the forum internum that might apply to situations where for various reasons it is not, necessarily accurate to maintain that persons have an absolute right to their own thoughts. For the purpose of proposing such an understanding, the article engages with current debates within human rights theory and political philosophy and analyzes discussions about psychotic delusions and the way in which involuntary treatment is justified. Based on this analysis, this article in turn conceptualizes freedom in the forum internum as ‘negative liberty’, ‘authenticity’, and ‘capability’. This article suggests that when forum internum is redefined as encompassing a right to certain internal capabilities, the right remains meaningful for persons with psychotic delusions as well.
